Email sending rule with a new comment

I have an email sending rule as below. It is triggered when a new comment is added on the condition when a date field is changed and I have that field on the comment form. However, the system is sending the email even though I do not change that field at all. I do change other fields on the form and/or write a text comment but do not touch the date field which the email condition is based on. I wonder if this is a bug or if I am doing something wrong. Will appreciate any thoughts.

Update to 3.5 first, please. Let me know if it works ok in 3.5
